Backorders:
We will never purposely charge a customer for an item that we do not physically have in stock at the time of purchase. Occasional inventory discrepancies may occur due to inaccurate inventory counts. Orders are billed at the time of shipment for only the products that are being shipped. In the event of a backorder situation we will ship and bill the item when it comes available.
Order Status:
All tracking or ship date information will be emailed to you once your order has shipped.
Product Listings:
Performance V-Twins strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our Website. Due to human error and other determinates we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our website is labeled with an incorrect price due to some typographical, informational, technical or other error, Performance V-Twins shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.
Purchase Agreement:
Placing an order & tendering payment is a binding contract that can only be voided by express written agreement by both parties (Performance V-Twins and Buyer). You and Performance V-Twins agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Performance V-Twins. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Performance V-Twins.
Limitation of Liability:
IN ALL CIRCUMSTANCES PERFORMANCE V-TWINS PRODUCTS MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. PERFORMANCE V-TWINS PRODUCTS SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. PERFORMANCE V-TWINS PRODUCTS SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT PERFORMANCE V-TWINS PRODUCTS HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
Orders:
An order is not binding upon Performance V-Twins until it is accepted. Payment for product(s) ordered is due to prior to shipment. Customer can make payment by credit card. You agree to pay the amount(s) due to specified on the invoice.
Warranty:
Since these are high performance parts under extreme conditions, there is no warranty on parts. If there is a problem, please call us first.
Warranty Disclaimer: Due to the nature of performance applications, all products sold by Performance V-Twins are sold without expressed warranty of merchantability or fitness for a particular purpose. Performance V-Twins shall not under any circumstances, be liable for any special, incidental or consequential damages, including but not limited to, damages for loss of property or equipment, loss of profits or revenue, cost of purchased which may arise and/or result from the sale, or installation or use of these parts. Performance V-Twins reserves the right to make product improvements of changes without notice and without incurring liability with respect to similar products previously manufactured. These parts are made primarily for garden tractor pulling uses.
